(2) Kreidebuch is a web app (Progressive Web App) that runs in the browser and can be added to the home screen. It is not distributed through an app store.
(3) These terms apply to consumers. Deviating terms of users do not apply.

§ 3 Services
(1) Free version. Free of charge are: timer, logging workouts and results, history, benchmarks, personal bests per lift, exercises with instructions and exporting all your own data.
(2) Premium. Premium additionally includes: 1RM history and bests per rep count, insights (goals, monthly review, heatmap, streaks), planning, templates and programs, finding workouts, workout from a photo or screenshot, import from other apps, benchmark history and standards, photos with workouts, reminders via notification and a customizable home screen.
(3) Trial. From registration, you can use all features including Premium free of charge for 14 days. You do not need to provide any payment details. After the 14 days, you automatically continue with the free version. No paid subscription is created unless you take out Premium yourself. The trial is available once per person and account.
(4) Your data stays. When the trial or Premium ends, all your entries are kept. Only the Premium features are locked until you take out Premium again. You can always export your data free of charge.
(5) The app shows the exact scope of features before you take out Premium. Your subscription includes the scope described at the time of purchase, subject to § 10.
§ 4 Registration and conclusion of contract
(1) You create an account in the app, either directly with your email address or through a personal invitation link. Without an invitation link, you confirm your email address via a link we send you. The app shows whether signing up without an invitation link is currently possible. There is no entitlement to an invitation or an account.
(2) Kreidebuch is for people aged 16 and over. By registering, you confirm that you are at least 16 years old.
(3) Creating the account concludes a contract for free use.
(4) You can only take out Premium from the age of 18. By taking it out, you confirm that you are at least 18 years old.
(5) Taking out Premium. You choose the term (month or year) in the app and are taken to the payment page of our payment provider Stripe. There you can enter a voucher code. Before submitting, you see the price, term and included VAT summarized once more and can correct your entries. By clicking the button “Zahlungspflichtig abonnieren” (subscribe with obligation to pay), you make a binding offer. The contract is concluded when we activate Premium for your account. You receive a confirmation by email.
(6) Contract text. We do not store the contract text separately for you to retrieve. You can view, save and print these terms at any time at kreidebuch.de/agb. The confirmation email contains the essential contract details, these terms and the cancellation policy.
(7) The language of the contract is German.
§ 5 Prices and payment
(1) Premium costs €5.99 per month (monthly plan) or €53.99 per year (annual plan). All prices include statutory German VAT, currently 19%.
(2) The price is payable in advance for each term (month or year), first upon conclusion of the contract.
(3) Payment is processed by Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. The payment page shows which payment methods are available, for example card, Apple Pay, Google Pay or direct debit. For direct debit, we announce the collection by email at least one day in advance.
(4) You receive an invoice by email after each payment. You can also find your invoices in the app under Profile → Subscription → “Payment and invoices”.
(5) Price changes. Prices cannot be changed unilaterally. If we want to change the price of an ongoing subscription, we will first explicitly ask whether you want to continue at the new price. If you do not explicitly agree, the subscription continues at the previous price. We may then cancel it at the end of a term in accordance with § 6 (6). Silence or continued use does not count as consent.
(6) If a payment fails, we will inform you by email. Until the payment is made, we may lock the Premium features. Your data and the free version are not affected. Statutory claims for late payment remain unaffected.
§ 6 Term, renewal and cancellation
(1) Free account. It runs for an indefinite period. You can end it at any time by choosing “Delete account” in your profile. Your data will then be deleted; details are in the privacy policy. Export it first if you want to keep it.
(2) Monthly plan. The monthly plan runs for an indefinite period and is billed one month in advance. You can cancel it at any time effective at the end of the current billing month.
(3) Annual plan. The first term is twelve months. You can cancel at any time effective at the end of the first term. The cancellation must reach us no later than the last day of the term.
If you do not cancel, the subscription then continues for an indefinite period as a monthly plan at the monthly price of €5.99 and can be cancelled at any time effective at the end of the current billing month. We show you this follow-on price when you take out the annual plan. There are no unilateral price increases (§ 5 (5)). If you want an annual plan again, you can take one out at any time. We will remind you by email at least one month before the end of the first twelve months.
(4) How to cancel. The easiest way is in the app under Profile → Subscription → “Cancel contracts here”. Without logging in, you can use the button “Cancel contracts here” on our website (kreidebuch.de/en/cancel) or send an email to info@kreidebuch.de. You immediately receive a confirmation by email with the date, time and the point at which the subscription ends. If you do not specify a date, the cancellation takes effect at the earliest possible date.
(5) After Premium ends, § 3 (4) applies: your entries are kept, the Premium features are locked and the account continues as a free version.
(6) Cancellation by us. We can cancel Premium with one month’s notice effective at the end of a term, and the free account with two months’ notice. We will inform you by email and give you the opportunity to export your data.
(7) The right of both parties to terminate for good cause remains unaffected. Good cause for us exists in particular in the event of serious violations of § 9. If we terminate for good cause for which you are not responsible, we will refund amounts paid in advance on a pro rata basis.
§ 7 Promotions and voucher codes
(1) We occasionally run promotions, for example on Black Friday, or issue voucher codes.
(2) A promotion or voucher only applies as stated at the time of purchase, i.e. for the stated period, term and price. The discount usually only applies to the first term. After that, the regular price applies. We show you the regular price and when it applies before you buy.
(3) You must enter voucher codes before submitting your order. We cannot apply them afterwards. Unless stated otherwise for the promotion, one code can be redeemed per purchase. Codes cannot be combined and cannot be paid out in cash.
(4) If you withdraw from a contract concluded with a voucher, we refund the amount actually paid.
§ 8 Right of withdrawal for consumers
If you take out Premium as a consumer, you have a right of withdrawal. You pay nothing for the free version and the trial.
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (The Goodie Company GmbH, Siedlerstraße 4b, 97230 Estenfeld, Germany, phone: +49 160 94718976, email: info@kreidebuch.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not required.
You can also exercise your right of withdrawal online: in the app under Profile → Subscription → “Withdraw from contract”, or without logging in on our website at kreidebuch.de/en/withdraw (“Withdraw from contract here”). If you use this online option, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without delay, with information on the content of your withdrawal and the date and time it was received.
To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we must refund all payments we have received from you without delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

§ 9 Your obligations
(1) Keep your login details secret and do not share your account. An account belongs to exactly one person. If you notice misuse, please let us know immediately.
(2) You may only pass on invitation links to people you know. You may not sell them or distribute them publicly.
(3) Refer a friend. If someone creates an account through your invitation link and takes out a paid Premium subscription, you get one month of Premium free once their 14-day withdrawal period has ended and they have not withdrawn. The free trial does not count. If you have an ongoing subscription, we instead credit one monthly fee to your next invoice. There is a maximum of 12 months per calendar year. If the referred person pays with your payment method (card or account), there is no reward. The same applies if their payment is refunded or charged back before the reward is granted. If they use a payment method that has already triggered a reward, we will review the case. Your own second accounts, made-up people or bought sign-ups do not count; in such cases we may withdraw the reward. There is no cash payout. We may change or end the program for the future; rewards already earned remain.
(4) Content you share with others (workout templates, shared training plans, images with scheduled workouts) must be lawful. Do not upload images of other people without their consent or content you do not have rights to.
(5) If you share a template or plan, you allow us to show this content in the app to everyone with a Kreidebuch account, and allow those people to use and copy it in the app. If you stop sharing, we no longer show the content. Copies others have already made remain.
(6) The following are not permitted: automated scraping of the app, attempts to access other people’s data or bypass security measures, and any use that disrupts operation.
(7) In the event of violations, we may remove shared content, block the sharing feature and, in serious cases, terminate the account in accordance with § 6 (7). We take your legitimate interests into account and hear you first where reasonable.
§ 10 Availability, updates and changes to the app
(1) We provide Kreidebuch in the condition required by the contract during the contract term and install the necessary updates, including security updates. Because Kreidebuch is a web app, updates load automatically the next time you open it. Occasionally you need to reload the app. Please use an up-to-date browser.
(2) We aim for the app to be available as continuously as possible. For maintenance, security updates or disruptions beyond our control, the app may be temporarily unavailable. Entries you make offline are transferred as soon as a connection is available again. Your statutory rights in the event of defects (Sections 327 et seq. of the German Civil Code, BGB) remain unaffected.
(3) Beyond what is necessary to keep the app in the condition required by the contract, we may change the app if there is a valid reason. Valid reasons are in particular: adaptation to new technology or browsers, security, changed legal requirements, changes to third-party services that a feature depends on, and improvements and new features. Such changes do not incur any additional costs for you. We will inform you clearly and comprehensibly about the change.
(4) If a change affects your access to Kreidebuch or its usability more than insignificantly, we will inform you by email in good time beforehand about the type and time of the change and about your rights. You can then end the contract free of charge within 30 days of receiving the information, or from the change if it occurs later. We refund amounts paid in advance on a pro rata basis. This does not apply if the impairment is insignificant or if you can continue to use the unchanged version at no extra cost.
(5) Logging, history and exporting your data remain free of charge in any case.
(6) Changes to these terms only apply to existing contracts if you expressly agree to them. If you do not agree, the previous terms continue to apply.
§ 11 Health notice
(1) Kreidebuch is a training log. The app does not provide medical, physiotherapeutic or other health advice and does not replace coaching.
(2) Standards, Rx weights, ratings (for example “Advanced”), exercise descriptions, videos and templates from other users are general guidance. They do not take into account your state of health, your injuries or your fitness level.
(3) Functional fitness and strength training can be physically very demanding. Get a medical check-up before you start if you have pre-existing conditions or complaints or have not trained for a long time. Stop training if you notice pain, dizziness or shortness of breath. You train at your own risk. Liability is governed by § 12.
§ 12 Liability
(1) We are liable without limitation
- for intent and gross negligence,
- for damage resulting from injury to life, body or health,
- under the German Product Liability Act and
- to the extent we have given a guarantee.
(2) In the case of slight negligence, we are only liable if we breach an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you can regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract at the time it was concluded.
(3) Otherwise, liability for slight negligence is excluded.
(4) These limitations also apply in favour of our employees and agents.
(5) Paragraphs 1 to 4 apply accordingly to the free version and the trial.
(6) Your statutory rights in the event of defects in the digital product (Sections 327 et seq. BGB) remain unaffected.
(7) We back up the data daily. We still recommend backing up important entries occasionally using the export in the app.
§ 13 Privacy
How we process your data, including training and body data, photos, shared content, notifications and storage on your device, is described in the privacy policy. For body and training data, we ask for your explicit consent when you first start the app. You cannot use the app without it. You can export your data and delete your account yourself at any time.
§ 14 Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 15 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.
(2) You can send declarations to us by email to info@kreidebuch.de. We write to you at the email address of your account.
(3) If any provision of these terms is invalid, the rest of the contract remains valid. The invalid provision is replaced by the statutory provision.
